The international Patent application (PCT)
The international patent application according to the Patent Cooperation Treaty (PCT) provides a central application proceeding and an international search for appr. 180 member states. The application can be filed in any language.
30 (in some countries 31) months after the filing date (or the priority date) of a PCT application, national or regional phases can be introduced and national patents can be prosecuted. Until that point of time, no investment for translations, national official fees, foreign associates, etc. is necessary.
The typical costs for a PCT application can be subdivided in three stages:
With filing, costs of appr. 4.500 EUR become due (inclusive official fees for the international search).
19 months after the first filing it is possible to file a request for a preliminary international opinion on patentability. Such a request will cost appr. 2.000 EUR. (Today, this step is frequently omitted since the law changed recently).

30 (in some countries 31) months after the first filing the international application has to be nationalized, i.e. the national prosecution in all the member states now designated by the applicant has to be introduced. These costs vary from country to country. In average, appr. 8.000 EUR to 10.000 EUR are to be calculated for each country or regional convention (like the EPC). These costs include translation fees, official fees of the national patent offices and fees of foreign associates.
