With a technical protection right, a monopol position is earned to exclude any third party from the use of the technical subject matter claimed by this protection right.
Thus, the basis for any consulting by DTS is an individuell strategy for creating an own protection right protfolio (constructive patent strategy) as well as the professionell challenging of other IP-portfolios (destructive patent strategy).
DTS also writes opinions on IP-rights as well with respect to the validity, the monetary value as to the question of possible infringement or dependency of patents owned by third parties. Further, DTS carries out searches of existing IP-rights as well as prior art.

Constructive Patent Strategy
DTS provides the prosecution of IP-rights national and international. DTS assists with drafting the application, prosecuting the application before the Patent Offices and defending these applications against oppositions filed by third parties.
In case other parties infringe the IP-rights of our clients, DTS carries out the litigation within Germany and coordinates litigation in other countries. Thus, a return of the investement in the own IP-portfolio is achieved.
Destructive Patent Strategy
From time to time IP-rights are granted in error - these formally granted rights have to be cancelled, especially in case the owner of such rights starts to threaten the own circels of interest or starts to irritate the market.
In theses cases, DTS conducts opposition proceedings, nullity actions and the representation of the defendant in litigation proceedings.
